1. Services
We provide specialised transport services for vehicles, EWPs, forklifts, and machinery. All bookings are subject to availability, safety requirements, and these Terms.
2. Bookings
- Bookings can be made online or directly with us.
- Accurate pickup, drop-off, and load details must be provided.
- We may refuse or cancel a booking if conditions are unsafe, unlawful, or impractical.
- Bookings are only confirmed once payment is received or an account has been approved.
3. Pricing & Payment
Prices are in NZD, exclusive of GST unless stated otherwise. Payment is required at booking unless otherwise agreed. Extra charges may apply for after-hours service, waiting time, tolls, or difficult site access.
4. Cancellations & Refunds
- >24 hrs before pickup: full refund (less admin fee if applicable).
- <24 hrs before pickup: 50% fee.
- Same-day cancellation/no-show: full fee payable.
5. Customer Responsibilities
- Ensure safe site access and accurate load details.
- Provide correct weight, size, and condition information.
- Arrange adequate insurance for loads being transported.
- You indemnify Trinity Logistics against all losses, claims, or damages caused by inaccurate information, unsafe conditions, or non-compliance with these Terms.
6. Liability & Insurance
To the fullest extent permitted by law:
- We are not liable for indirect, consequential, or special loss (including lost profit, downtime, or economic loss).
- We are not responsible for pre-existing damage, wear and tear, or conditions outside our control (traffic, weather, third parties).
- Our total liability is strictly limited to the lesser of (a) the transport fee paid, or (b) the direct repair/replacement cost up to NZ$500 per load.
- You must arrange and maintain your own insurance for goods in transit. Our services do not include insurance cover.
7. Safety
We may refuse or stop a job if, in our sole discretion, it poses a safety risk or breaches transport regulations. Our driver’s decision on safety is final.
8. Online Platform & Payments
The website is provided “as is.” We use secure third-party providers for online payments, but we are not liable for issues arising from those third-party services. Customers must ensure booking details are correct before submitting.
9. Privacy
We collect and process customer details to deliver services. Data may be shared with third parties only as needed to complete a booking. See our Privacy Policy for more.
10. Governing Law
These Terms are governed by New Zealand law. Any disputes will be resolved exclusively in New Zealand courts.
11. Changes
We may update these Terms from time to time. The version displayed on our website at the time of booking applies.
12. Exclusion of Warranties
Except as required by law, all warranties, conditions, and representations (express or implied) are excluded. To the maximum extent permitted by law, Trinity Logistics is not liable for any claim whatsoever beyond those expressly provided in these Terms.
